Two of the seven Arizona Justices voted against it, and one abstained. The five men and two women were all appointed by Republican governors.

The justices behind the majority opinion are Justices John Lopez, James Beene, Bolick and King.

Justice Lopez writing the majority opinion:

“A policy matter of this gravity must ultimately be resolved by our citizens through the legislature or the initiative process… we merely follow our limited constitutional role and duty to interpret the law as written.”

Chief Justice Robert Brutinel and Vice Chief Justice Ann Timmer voted against the enforcement.

Vice Chief Justice Timmer wrote the dissenting opinion, explaining:

“The majority mistakenly returns us to the territorial-era abortion statute last operative in 1973. I would leave it to the people and the legislature to determine Arizona’s course in the wake of Roe’s demise. With great respect for my colleagues, I dissent.”

Has anyone even though about why the topic of abortion came up in the Territory of Arizona during a Civil War in the year 1864? Having reviewed history it really comes down to immigrants having to many babies (I know right. They were trying to Make America Great “MAG” in 1864), and the low birth rates of babies being born by White Women. Not to mention the fact that these women died at high rates during pregnancy and childbirth because it is afterall 1864. Oh yeah and the Midwifery competition. The Arizona law in 1864 made abortion before the detection of fetal movement a felony, punishable by two to five years in prison for anyone who performed an abortion or helped a woman obtain one, except to save the woman’s life. Mary Ziegler, a legal historian at the University of California, Davis School of Law, said, “These laws all passed at the behest of the AMA, which wanted more power and discretion.”
